On August 4th,Xiangtan Hengxin learned from the Shaoshan Procuratorate that the Xiangtan Intermediate People's Court's final judgment upheld the Shaoshan People's Court's final verdict on the crime of infringing on the trade secrets of Xiangtan Hengxin by Zhu,the former general manager of Yangzhou Best Machinery Equipment Co.,Ltd.(referred to as"Yangzhou Best"),and Li,the former technical director.
Zhu and Li have respectively worked in sales and technology at Xiangtan Hengxin,and both have signed confidentiality agreements with Xiangtan Hengxin and received confidentiality fees.In 2009 and 2010,Zhu switched jobs to Yangzhou Best.Despite knowing that Li's technical information was a trade secret of"Xiangtan Hengxin",Zhu still allowed Li to bring the stolen"Xiangtan Hengxin"trade secret into Yangzhou Best's product production and sales.After obtaining certain evidence,Xiangtan Hengxin reported the case to the Public Security Bureau,which transferred the case to the Procuratorate for prosecution.In 2014,the People's Court of Shaoshan City held a trial and made a first instance judgment on Zhu and Li for committing a crime by infringing on the trade secrets of Xiangtan Hengxin.They were sentenced to three years in prison,and later appealed to the Xiangtan Intermediate People's Court against the first instance judgment,The Intermediate People's Court of Xiangtan City held a trial in January 2015 and made a final judgment in June 2015,which upheld the conviction of the People's Court of Shaoshan City for the crime of two people infringing on trade secrets.
